Welcome to Casablunta. This document establishes the contractual framework governing your relationship with The Collective . By accessing our digital architecture, engaging with our platform, or acquiring our artifacts, you—The Resident—enter into a binding agreement with Casablunta LLC (Pty) Ltd . These Terms of Residency represent more than legal formality; they are the structural foundation upon which The Higher Standard is built .

Your continued use of our services constitutes unconditional acceptance of these terms . If you do not agree, you must immediately cease all use of our platform and services .

1. Definitions & Interpretation

For purposes of architectural clarity, the following terms shall have the meanings ascribed below :

• "The Collective" or "Casablunta" or "we" or "us": Refers to Casablunta LLC (Pty) Ltd, a company incorporated under the laws of the Republic of South Africa .
• "The Resident" or "you": Refers to any individual or entity accessing or using our services .
• "Platform": Refers to our website, mobile applications, and all associated digital infrastructure .
• "Artifacts": Refers to all products, garments, and goods offered for sale by Casablunta .
• "Services": Refers to all offerings provided by Casablunta, including but not limited to product sales, content access, and customer support .
• "The Higher Standard": Refers to the ethos, quality benchmarks, and operational principles that govern The Collective .

2. The Collective Agreement (Acceptance of Terms)

By accessing our architectural space and acquiring our artifacts, you agree to abide by the protocols set forth by The Collective . These terms constitute the complete and exclusive framework of our engagement . Entering this space—whether through browsing, account creation, or purchase—signifies your unconditional acceptance of The Higher Standard and all terms contained herein . This agreement supersedes all prior communications, representations, or agreements, whether oral or written . Any contradictory terms in purchase orders, confirmations, or other documents are hereby rejected and shall have no force or effect .

2.1 Eligibility

You must be at least 18 years of age to use our services . By accessing the Platform, you represent and warrant that you possess the legal capacity to enter into binding contracts . Residency is extended only to those who can form legally binding contracts under applicable law .

3. Residency Protocols (Acceptable Use)

The Resident agrees to use our Platform for lawful purposes only and in a manner consistent with The Higher Standard . You shall not:

• Violate any applicable local, national, or international law or regulation
• Infringe upon or misappropriate our intellectual property, including trademarks, copyrights, designs, or trade secrets
• Engage in unauthorized scraping, data mining, or automated extraction of content
• Introduce viruses, malware, or any code designed to disrupt or damage our infrastructure
• Impersonate any person or entity, or falsely represent your affiliation with any entity
• Interfere with or disrupt the integrity or performance of the Platform
• Attempt unauthorized access to our systems, accounts, or data
• Use the Platform for fraudulent purposes or in connection with any criminal activity

We reserve the right to terminate residency (access) immediately and without notice for any violations of these structural laws . Such termination does not waive our right to pursue legal remedies for damages incurred .

4. Account Registration & Security

To access certain features, you may be required to create an account. You agree to :

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information to keep it accurate
• Maintain the confidentiality of your login credentials
• Accept responsibility for all activities conducted under your account

You must immediately notify us of any unauthorized use of your account or any other security breach . We are not liable for any loss arising from unauthorized use of your credentials, whether with or without your knowledge .

5. Artifacts & Services (Product Information)

5.1 Product Descriptions

We strive to display the colors, textures, and images of our artifacts as accurately as possible . However, we cannot guarantee that your device's display of any color or texture will be entirely accurate . All dimensions, weights, and specifications are approximate and subject to minor variations inherent in handcrafted or manufacturing processes .

5.2 Availability & Limitations

All artifacts are subject to availability. We reserve the right to :

• Limit the quantity of artifacts sold to any person, household, or geographic region
• Refuse service to any individual or jurisdiction at our sole discretion
• Discontinue any artifact at any time without notice
• Modify product specifications, pricing, or availability without prior notice

5.3 Pricing & Payment

All prices are displayed in South African Rand (ZAR) unless otherwise stated and include applicable VAT . Prices are subject to change without notice. We reserve the right to correct pricing errors, even after an order has been placed . Payment must be received in full before artifacts are dispatched. By providing payment information, you represent that you are authorized to use the payment method provided .

6. Orders & Contractual Formation

6.1 Order Process

When you place an order, you are making an offer to purchase the artifacts under these Terms . All orders are subject to acceptance by Casablunta. We reserve the right to refuse or cancel any order for any reason.

6.2 Order Confirmation

Receipt of an order confirmation email does not constitute our acceptance of your order. A contract between you and Casablunta is formed only when we dispatch the artifacts and send you a shipment confirmation. Until that point, we may decline your order without liability.

6.3 Order Cancellation

Once an order has been confirmed and dispatched, it cannot be cancelled. You may return artifacts in accordance with Section 8 (Returns & Refunds).

7. Delivery & Title Transfer

7.1 Delivery Timeframes

We aim to dispatch artifacts within the timeframes indicated at checkout. However, delivery dates are estimates only and not guaranteed. We are not liable for delays caused by courier services, customs, force majeure, or other events beyond our reasonable control.

7.2 Risk & Title

Risk of loss and title to artifacts pass to you upon delivery to the carrier. You are responsible for inspecting artifacts upon receipt and notifying us of any damage or discrepancies within 48 hours.

7.3 International Delivery

International Residents are responsible for all customs duties, taxes, and import fees. Casablunta is not liable for delays or confiscation by customs authorities. By placing an international order, you confirm compliance with all applicable import laws.

8. Returns & Refunds

8.1 Return Policy

We accept returns within 14 days of delivery, provided artifacts are:

• Unworn, unwashed, and in original condition with all tags attached
• Returned in original packaging
• Non-returnable items include: Sale or clearance items, customized or personalized artifacts, and any items explicitly marked as final sale.

8.2 Refund Process

Upon receipt and inspection of returned artifacts, we will issue a refund to your original payment method within 10 business days. Shipping costs are non-refundable unless the return is due to our error.

8.3 Defective or Incorrect Items

If you receive a defective or incorrect artifact, contact us at support@casablunta.com within 48 hours of delivery. We will arrange for return shipping at our expense and provide a full refund or replacement at your election.

9. Intellectual Property Rights

9.1 Ownership

All content on the Platform—including but not limited to text, graphics, logos, images, designs, photographs, software, and compilation thereof—is the exclusive property of Casablunta or our licensors and is protected by South African and international copyright, trademark, patent, and other intellectual property laws.

9.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for personal, non-commercial purposes in accordance with these Terms. This license does not permit reproduction, commercial use, or reverse engineering.

9.3 Trademarks

CASABLUNTA, THE COLLECTIVE, THE HIGHER STANDARD, and all associated logos are trademarks of Casablunta LLC (Pty) Ltd. Unauthorized use is strictly prohibited .

10. Warranties & Disclaimers

We warrant that artifacts will be free from material defects in materials and workmanship under normal use for a period of 30 days from delivery. THE PLATFORM AND ALL SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW: Casablunta shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from or relating to your use of the Platform. Our total liability for any claim shall not exceed the amount you paid for the specific artifact or service giving rise to the claim, or ZAR 1,000, whichever is less.

12. Indemnification

You agree to indemnify, defend, and hold harmless Casablunta from and against any and all claims, liabilities, or expenses arising from your violation of these Terms, third-party rights, or content you submit to the Platform.

13. Force Majeure

Casablunta shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, war, pandemics, or supply chain disruptions.

14. Privacy & Data Protection

Your use of the Platform is also governed by our Privacy Policy (Data Sanctity), which is incorporated into these Terms by reference. By using our services, you consent to the collection and use of your personal information as described therein.

15. Modifications to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated at least 14 days before taking effect. Your continued use of the Platform after amendments constitutes acceptance of the modified Terms.

16. Governing Law & Jurisdiction

These Terms of Residency shall be governed by and construed in accordance with the laws of the Republic of South Africa. You irrevocably submit to the exclusive jurisdiction of the courts of Johannesburg, South Africa, for the resolution of any disputes.

17. Dispute Resolution

In the event of any dispute, the parties agree to first attempt to resolve the matter informally by contacting support@casablunta.com. If informal resolution fails, either party may elect binding arbitration under the rules of the Arbitration Foundation of Southern Africa (AFSA).
